PERSONAL DATA PROTECTION LAW (KVKK) CLARIFICATION TEXT AND EXPLICIT CONSENT FORM

CLARIFICATION TEXT

This Clarification Text sets out the principles regarding the processing of personal data by the data controller Güray Gayrimenkul Geliştirme İnşaat Anonim Şirketi (Güray Real Estate Development Construction Joint Stock Company), in accordance with the Law on the Protection of Personal Data No. 6698 ("the Law") and related legislation.

1. Identity of the Data Controller

Güray Gayrimenkul Geliştirme İnşaat Anonim Şirketi holds the title of Data Controller pursuant to the Law with respect to the personal data it collects.

2. Purpose and Legal Basis for the Collection and Processing of Personal Data

Güray Gayrimenkul Geliştirme İnşaat Anonim Şirketi may process your personal data for the purposes stated below, within the scope of the personal data processing conditions specified in Articles 5 and 6 of Law No. 6698:

Your personal data, including but not limited to identity information, contact information, financial information, and customer transaction information, may be collected and processed in physical, verbal, written, or electronic environments for the purposes of fulfilling contractual obligations, managing customer relations, providing the services offered by the company in accordance with your needs, keeping data accurate and up to date, planning customer satisfaction processes, planning and executing marketing activities, managing requests or complaints, and fulfilling our legal obligations.

3. Recipients of Processed Personal Data and Purpose of Transfer

Personal data may be shared with our business partners, third-party service providers, suppliers, subcontractors, and official authorities in accordance with applicable legal regulations. The purpose of processing personal data and the purpose of data transfer are aligned.

4. Storage and Security of Your Personal Data

Your personal data may be retained for as long as required by the purposes for which it is processed. In the absence of any legal basis for retention after the processing purpose has ceased, your personal data will be deleted, destroyed, or anonymized. In order to ensure that your personal data is processed lawfully and stored securely, and to prevent unauthorized access to your personal data, Güray Gayrimenkul Geliştirme İnşaat Anonim Şirketi takes all necessary technical and administrative measures to maintain an appropriate level of security.

5. Methods of Application to the Data Controller and Your Rights

By applying to our Company, you have the right to:

  • Learn whether your personal data is being processed,
  • Request information if your personal data has been processed,
  • Learn the purpose of processing your personal data and whether it is being used in accordance with that purpose,
  • Learn the parties to whom your personal data has been transferred domestically or abroad,
  • Request the correction of your personal data if it is incomplete or incorrectly processed,
  • Request the deletion or destruction of your personal data within the framework of the conditions set forth in the applicable legislation,
  • Request that corrections, deletions, and destructions carried out in accordance with the legislation be notified to third parties with whom your personal data has been shared,
  • Object to the emergence of a result against you through the analysis of your processed personal data exclusively by automated systems,
  • Request compensation for damages in the event that your personal data is processed unlawfully.

Our Company will finalize your requests free of charge, as soon as possible and within thirty days at the latest, depending on the nature of the request. However, a fee may be charged if the transaction involves an additional cost. Our Company may accept and process the request, or reject it in writing with a stated justification.

In the event that an application made by following the above-mentioned procedure is rejected, the response given is found to be inadequate, or no response is provided within the stipulated time; you have the right to file a complaint with the Personal Data Protection Board ("the Board") within thirty days following the notification of the response, and in any case within sixty days from the date of application. However, the complaint procedure cannot be initiated without first exhausting the application process. We would like to assure you that your data is handled with the utmost care by our Company, and we thank you for the trust you have placed in us. I have read and understood the clarification text within the scope of the Law on the Protection of Personal Data.

EXPLICIT CONSENT TEXT REGARDING THE PROCESSING OF PERSONAL DATA

Do you consent to the processing of your personal data by Güray Gayrimenkul Geliştirme İnşaat Anonim Şirketi for the following purposes?

Within the scope of your explicit consent, your personal data, including sensitive personal data, may be processed for the purposes of planning and executing customer relationship management processes, planning and executing marketing activities, introducing and providing the services offered by the company in accordance with your needs, acquiring customers, fulfilling contractual obligations, planning customer satisfaction processes, managing requests or complaints, and fulfilling our legal obligations. For the purposes stated herein, your personal data may be shared with our business partners, third-party service providers, suppliers, subcontractors, and official authorities to the extent permitted by applicable legislation.

I acknowledge and declare that I have read and understood the Clarification Text and the Consent Text regarding the processing of my personal data. I hereby consent to the processing and sharing of my personal data for the purposes stated herein.
